Improvements to Arizona Department of Environmental Quality (ADEQ) Leaking Underground Storage Tank (LUST) programs provide a win-win both for Arizona’s environment and ADEQ customers. These programs, made possible by Arizona House Bill 2636, mean fast corrective actions for LUSTs and quick reimbursements for cleanup costs.
- Preapproval program – Eligible UST owners, operators and/or landowners can receive corrective action cost financial assistance when not covered by a financial assurance mechanism. ADEQ estimates plan approval to take about a month and subsequent reimbursements about a week (invoice receipt to payment) – a drastic improvement over the former program (the state assurance fund (SAF), sunset in 2010), which took four or more months for plan approval and about seven for reimbursements.
- Time-barred program – UST owners and operators “time-barred” from submitting LUST cleanup costs since the SAF sunset now can submit a “UST time-barred claim” application for reimbursement.
