The Wyoming Department of Environmental Quality’s request to directly implement a Class VI permitting program for carbon capture and storage injection wells has taken a significant step forward. On April 1, U.S. EPA announced that it is seeking public input on the agency’s intent to approve Wyoming’s request for primacy in regulating Class VI wells under the Safe Drinking Water Act Underground Injection Control Program.
This would make Wyoming only the second state to be granted a primacy request under the Class VI program, following North Dakota, whose program was approved in 2018. The two programs could serve as national templates.
The Class VI program, which applies to industrial facilities and power plants, details requirements that are more stringent than Class II permits.
